1. Scope
(a) This policy applies to the collection, use, disclosure and handling of your Personal Information by The Giving Movement Australia Pty Ltd (ACN 679 818 976) (“TGM AUS”) in relation to the website (https://thegivingmovement.com.au).
(b) TGM AUS is committed to protecting the privacy of all persons with who it has dealings. TGM AUS abides by the Australian Privacy Principles as set out in the Privacy Act 1988 (Cth) (“Privacy Act”) as well as the General Data Protection Regulation (“GDPR”) where applicable.

(a) Personal Information has the same meaning given to it in the Privacy Act (“Personal Information”).

8. When TGM AUS will use or disclose Personal Information

(i) TGM AUS is under a legal duty or obligation to disclose Personal Information
about the person, or TGM AUS is otherwise compelled to disclose such

(iii) the person would reasonably expect TGM AUS to use or disclose the Personal
Information for the secondary purpose and the secondary purpose is directly
related to the primary purpose; or
(iv) TGM AUS reasonably believes that the use or disclosure of the information is
reasonably necessary for enforcement related activities conducted by or on behalf
of TGM AUS.
(b) TGM AUS will not disclose Personal Information of a person to a third party without the express consent of the person.


9. Personal Information of Individuals to be kept up-to-date
(a) TGM AUS will take reasonable steps to ensure that the Personal Information it collects,
uses and discloses is accurate, complete and up-to-date.
(b) A person is entitled to update, amend or delete Personal Information with respect to that particular person.

10. Requests for access to Personal Information
(a) A person is entitled to access any Personal Information that TGM AUS holds about them, unless:
(i) TGM AUS reasonably believes that giving access would pose a serious threat to the life, health or safety of any person;
(ii) giving access would unreasonably impact the privacy of others;
(iii) the request for access is frivolous or vexatious;
(iv) the information relates to existing legal proceedings between TGM AUS and the person, and would not be discoverable in those proceedings;
(v) giving access would reveal TGM AUS’s intentions in negotiations with the person and prejudice those negotiations;
(vi) access would be unlawful;
(vii) denying access is required or authorised by an Australian law or court or tribunal order;
(viii) TGM AUS has reason to suspect that unlawful activity or serious misconduct
relating to its activities has been or is being engaged in, and giving access would
prejudice its action in relation to this activity or misconduct;
(ix) giving access would be likely to prejudice enforcement related activities being
conducted by an enforcement body; or
(x) giving access would reveal evaluative information generated within TGM AUS inconnection with a commercially sensitive decision-making process.
(b) All requests for access to Personal Information should be addressed to TGM AUS in writing.
(c) Requests for access will be responded to as soon as practicable, and any refusal for access must be supported by reasons and applicable exceptions under the Privacy Act.
(d) A person may request the correction of Personal Information which relates to them. TGM AUS will take reasonable steps to correct the information as soon as practicable.

11. Cookies
(a) TGM AUS uses cookies and similar tracking technologies to track the activity on TGM AUS’s website and hold certain information. Cookies are files with small amount of data which may include an anonymous unique identifier. Cookies are sent to a person’s browser from a website and stored on the device. Tracking technologies also used are beacons, tags, and scripts to collect and track information.
(b) A person can instruct their browser to refuse all cookies or to indicate when a cookie is being sent. However, if a person does not accept cookies, a person may not be able to use some portions of TGM AUS’s website.

TGM AUS will make the required notification to the person in the event of a data breach and in accordance with the Privacy Act as well as the Privacy Amendment (Notifiable Data Breaches) Act 2017.
